Terms of use

1. What ChartPeak is

ChartPeak is an educational tool operated by ChartPeak. It reads an image of a price chart and returns a structured description of it, together with a journal for your own trades and a reference library. You use it on your own device, at your own discretion. By creating an account or subscribing, you agree to these terms, the privacy policy and the risk disclosure.

2. Not financial advice

Nothing ChartPeak produces is financial, investment, tax or legal advice, and nothing in it is a recommendation to buy, sell or hold anything. ChartPeak is not a broker, a dealer, an investment adviser or a financial institution, and no relationship of that kind is created by your use of it.

The app does not know your finances, your risk tolerance, your existing positions or your circumstances. Every trading decision you make is yours alone. Trading carries a substantial risk of loss, including the loss of more than you put in. Past performance does not indicate future results. If you need advice, consult a licensed professional. The risk disclosure says this at greater length.

3. The analysis can be wrong

Reads are produced by an automated model interpreting an image, and they can be inaccurate, incomplete or mistaken. The model can misread a chart, miss a level, or describe a pattern that is not present. ChartPeak is provided as is and as available, without warranty of any kind, express or implied, including any warranty of accuracy, merchantability, fitness for a particular purpose or non-infringement.

You are responsible for verifying anything you rely on. Do not treat a read as a deciding vote.

4. Your account

• You must be at least 18 years old to use ChartPeak.
• You are responsible for keeping your sign-in details private and for everything done through your account.
• One account is for one person. Do not share it or sell access to it.
• You can delete your account at any time from the Profile tab. See the account deletion page.

5. Acceptable use

You agree not to:

• submit images you do not have the right to submit, or that contain someone else’s personal or confidential information;
• bypass, probe or overload the usage limits, the analysis service or the authentication system, or use scripts, bots or multiple accounts to do so;
• reverse engineer, decompile or copy the app, or use it or its output to build or train a competing service;
• resell, redistribute or publicly present ChartPeak’s reads as advice, signals or recommendations, to anyone, for payment or otherwise;
• use ChartPeak for anything unlawful, or in a way that interferes with its operation for other people.

We may suspend or close an account that breaks these rules. Where the breach is abuse of the analysis service, we may do so without notice, because every read costs us money.

6. Subscriptions and billing

ChartPeak is offered as an auto-renewing subscription purchased through Apple’s App Store, and through Google Play when the Android version is listed. Two plans are available: $7.99 a week and $39.99 a year, in US dollars; your store shows the local equivalent. Prices can change, and the store tells you before a change applies to a renewal.

• Payment is charged to your store account at confirmation of purchase.
• A subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the period ending.
• You can manage or cancel a subscription in your Apple ID or Google Play settings at any time. Cancelling stops the next renewal; you keep access until the paid period ends.
• Refunds are handled by the store under its own policy, not by us. The refund policy explains how to request one.
• From time to time we may show a discounted offer inside the app. An offer’s price and period are stated on the screen that presents it, and it is subject to these terms.

There is no free tier and no free read. The app shows what a read looks like before you are asked to pay, and the price is published on this website.

7. Fair use limits

A subscription includes chart reads subject to fair use limits: up to 60 reads per account per day across all your devices, and a short-burst limit of 6 per minute. The daily count resets at midnight UTC.

These limits exist to prevent abuse of the analysis service rather than to meter ordinary use, and they cannot be purchased past. A read that reaches the service counts toward the limit even if the result is not usable. We may adjust these limits; the current figures are always published on the privacy page.

8. Your data and your content

Your journal and saved reads are stored on your device, not by us. We do not back them up and cannot restore them. Deleting the app deletes them. The privacy policy says what we do hold and what happens to a chart image you submit.

You keep whatever rights you have in the images you submit. You give us the limited right to transmit each image to our analysis provider and return the result to you, which is the only thing we do with it.

9. Our content

The app, the website, the Academy material, the design and the ChartPeak name and mark belong to ChartPeak or its licensors. You may use them through the app for your own personal, non-commercial purposes. You may not copy, republish or resell them.

10. Availability and changes to the service

ChartPeak depends on third-party services, including a model provider and a hosting provider, and it can be unavailable when they are. We do not promise uninterrupted service. We may change, add or remove features, and we may change the model that produces reads. If a change removes something your subscription plainly included, you can cancel and the store’s refund policy applies.

11. Limitation of liability

To the fullest extent permitted by law, ChartPeak is not liable for any trading losses, lost profits, lost data, or any indirect, incidental, special, consequential or punitive damages arising from your use of the app or your reliance on anything it produced. Our total liability to you for any claim is limited to the amount you paid for the subscription in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

12. Indemnity

You agree to cover us against claims, losses and costs that arise from your breach of these terms or your misuse of the app, including any claim that an image you submitted infringed someone else’s rights.

13. Termination

You can stop using ChartPeak and delete your account at any time. We can suspend or end your access if you break these terms, and we tell you why unless the law prevents it. Sections 2, 3, 8, 9, 11, 12 and 14 survive termination.

14. Governing law and disputes

These terms are governed by the laws of the jurisdiction in which ChartPeak is established, without regard to conflict-of-law rules, and disputes are brought in the courts there. If you are a consumer, you keep any protection the law of your own country gives you that cannot be contracted away. Before going to court, write to us; most problems are quicker to fix than to litigate.

15. Apple and Google

If you got the app from the App Store, Apple is not a party to these terms, has no obligation to provide maintenance or support, and is not responsible for any claim about the app; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. The same applies to Google for an app obtained from Google Play. Where these terms conflict with the store’s own terms, the store’s terms prevail for matters they cover.

16. Changes to these terms

These terms may change. Continued use after a change means you accept the updated terms. Material changes are signalled in the app rather than left for you to find here. The date at the top is the date of the current version.
